Terms & Conditions
These Terms apply to all quotations, bookings and works by Ansell Painting Group (ABN 68 684 717 404) unless we agree otherwise in writing. By accepting our quote, paying a deposit, or allowing us to start work, the client agrees to these Terms. Nothing in these Terms limits your rights under the Australian Consumer Law.
Scope of Works

Works are as per our written quotation and inclusions/exclusions. Any item not listed is excluded.

Colour/finish selections must be confirmed in writing before scheduling. We rely on your instructions, samples, and colour codes.
Variations

Variations (e.g., extra areas, additional coats, change of products, repair of unforeseen defects) must be approved in writing and will be charged at the quoted variation rate or at our standard rates plus materials.

Unforeseen conditions (e.g., moisture ingress, rotten timber, lead/asbestos, structural movement) will be reported and priced as a variation.
Client Responsibilities

Provide safe, clear access, power, lighting, and amenity (toilet/water) during working hours.

Move/cover furnishings and valuables unless we agree to include this. We take reasonable care but are not liable for pre-existing damage or concealed defects.

Ensure pets and children are kept clear of work areas and wet coatings.
Surface Preparation & Materials

Standard prep includes fill minor holes/defects, sand, spot prime where required. Significant repairs, plastering, caulking, stain blocking, rust treatment, water damage remediation, or sealing of smoke/nicotine are variations unless specifically listed.

We supply trade-quality products suitable for the substrate and environment (brand may vary to equivalent unless a specific brand is specified).
Lead/Asbestos & Hazardous Materials
If lead paint, asbestos, mould, or other hazardous materials are suspected, we will pause works and provide options. Testing/removal is a variation and may require licensed contractors.
Protection & Clean-up
We will mask/protect adjacent surfaces, tidy daily, and remove our paint waste. On completion we will remove our gear and leave areas clean and free of debris.
Program, Access & Delays

Start/finish dates are estimates and may be affected by weather, site readiness, preceding trades, or supply. We are not liable for consequential loss due to delays beyond our control (force majeure).

External works are weather-dependent; re-attendance due to rain/condensation/wind may incur re-booking delays.
Payment

Unless stated otherwise: 30% deposit to book, progress claims for multi-day/multi-stage projects, balance due on completion.

Payment methods: bank transfer, cash. Late payments may attract [x]% per month admin/interest and recovery costs.

For fixed-price quotes, prices are valid for 60 days unless the paint price increases. Our quote is based on the permitted use of spray and roller equipment.
Warranty

Workmanship warranty:5-yaer from completion against peeling/flaking due to defective prep/application (fair wear/tear, substrate movement, water ingress, poor maintenance, or third-party damage excluded). Product warranties are per manufacturer.

You must maintain surfaces per manufacturer guidance and notify us promptly of any defect.
Insurance & WHS
We hold public liability insurance of $10 million and, where applicable, workers compensation. We comply with WHS requirements and may refuse unsafe work conditions.
Photos & Marketing
You consent to us taking completion photos for records and marketing; no address or personal identifiers will be published. Tell us in writing if you do not agree.
Cancellations & Rescheduling
If you cancel within 3 business days of the start date, a cancellation fee up to actual costs incurred (e.g., ordered materials, lost slot) may apply. Weather rescheduling is at our discretion.
Defects & Practical Completion
Practical Completion occurs when works are complete apart from minor touch-ups that do not prevent normal use. Provide a punch list within 10 business days; we will attend to reasonable items.
Liability
To the extent permitted by law, our liability is limited to re-supply of services or payment of the cost of having the services supplied again. We are not liable for indirect or consequential loss.
Title & Risk
Materials remain our property until paid in full. Risk in the work passes to you at completion.
Subcontracting
We may engage qualified subcontractors while remaining responsible for the works.
Dispute Resolution
If a dispute arises, each party will try to resolve it in good faith within 14 days. If unresolved, either party may refer to Victoria small business/dispute service or courts of [State/Territory] jurisdiction.
Privacy
We handle personal information under our Privacy Policy (see website or on request).
